I was injured while working. What should I do?

Often times we have people give us a call about having been injured at work and many people don’t understand the concept of workers’ compensation.

In Pennsylvania, if you’ve been injured during the course and scope of your employment, you are entitled to rights under the Workers’ Compensation Act.

What’s that mean?

That means that your employer has a legal obligation to carry workers’ comp insurance which will cover your medical bills.

If you’ve been injured at work what should you do?

The first thing you want to do is notify your supervisor, unless it’s a true emergency, in which case you don’t have the time or ability to notify your supervisor and you need to get to an emergency room. Obviously, take care of your health first, but in those other situations you want to notify your supervisor, tell them you’ve been injured and tell them how you were injured. At that time, they should provide you and had previously provided you a list of panel physicians, which means a list of doctors they work with and they will send you to.

Sometimes there are exceptions to this rule, and that’s why you need to speak with a lawyer about whether you need to see one of these panel physicians and how long you need to see a panel physician. These are very nuanced things, but for most basic cases if you were injured in the course and scope of your employment you should notify your employer. Emergency situations you should get to the emergency room and follow through with the employer’s doctors, going to their appointments, and following your initial injury and treatment you should contact an experienced workers’ compensation and personal injury attorney to find out what to do next in order to get back to work, get healthy, and move on with your life.
